TERMS AND DEFINITIONS

In this offer, unless the context requires otherwise, the following terms shall have the meanings set forth below and constitute an integral part hereof:

“Seller” – Individual Entrepreneur (FOP) Tykhyi Andrii Liubomyrovych (EDRPOU code 2878603079), registered in Ternopil Region, Ternopil District, Berezhany, Deputatska St. 6/7.

“User” – any legally capable natural or legal person visiting the website https://linnicaro.ua/ who accepts all terms of this offer and intends to place an order for Goods.

“Buyer” – any legally capable natural or legal person, a User of the website https://linnicaro.ua/, who places an order on the online store website https://linnicaro.ua/ for the purpose of purchasing Goods and thereby confirms their agreement with all terms of this offer.

“Online Store” – the official online store of the Seller located at https://linnicaro.ua/, which, in accordance with the Law of Ukraine “On Electronic Commerce,” is a means of providing or selling goods, works, or services through the conclusion of an electronic agreement.

“Goods” – the object of the transaction between the parties (clothing items, accessories, or other tangible property) offered for sale in the online store.

“Acceptance” – the Buyer’s full and unconditional consent to enter into this Agreement in its entirety without signing a written copy of the Agreement by the Parties.

“Order” – a duly completed and placed order of the Buyer (completion of relevant fields on the website in the “Cart” / “Checkout” section) addressed to the Seller for the sale and delivery of Goods selected in the online store to the address specified by the Buyer.

“Custom Order” – a duly placed order providing for the manufacture of Goods based on the Buyer’s individual measurements that differ from the size chart published on https://linnicaro.ua/.

GENERAL PROVISIONS

2.1. This Agreement is a public offer agreement pursuant to Articles 633 and 641 and Chapter 54 of the Civil Code of Ukraine. Its terms are the same for all Buyers regardless of status (individual, legal entity, or individual entrepreneur).

2.2. Upon acceptance of the terms of this public offer, the Consumer becomes a Buyer.

2.3. By entering into this Agreement, the Buyer confirms full acquaintance with and acceptance of its terms and, if the Buyer is an individual, grants consent to the Seller for the processing of personal data for the purpose of fulfilling this Agreement, conducting settlements, and issuing invoices, certificates, and other documents. Consent to the processing of personal data remains valid for the entire duration of the Agreement and for an unlimited period after its termination. The Buyer also confirms being informed of their rights under the Law of Ukraine “On Personal Data Protection,” the purposes of data collection, and the transfer of personal data to the Seller for the purposes specified above. The Buyer agrees that the Seller may provide access to and transfer personal data to third parties without additional notice, without changing the purpose of data processing. The scope of the Buyer’s rights as a data subject is known and understood.

2.4. The Agreement enters into force upon confirmation by the Seller in any form of acceptance of the Buyer’s Order placed on the online store website or upon acceptance of an Order placed by phone as indicated on the website.

2.5. By providing their phone number and email address, the Buyer consents to their use by the Seller and third parties involved in fulfilling obligations to the Buyer, including notifications regarding order delivery and other information directly related to order fulfillment.

2.6. By placing an Order, the User/Buyer agrees that the Seller may engage third parties to perform this Agreement while remaining fully responsible for its performance.

2.7. All textual information and graphic images of Goods posted on the website are the property of the Seller or its counterparties. Viewing or printing website pages is permitted for personal use only.

SUBJECT OF THE AGREEMENT

3.1. The subject of this Agreement is the provision of an opportunity for the User to purchase Goods presented in the online store for personal use not related to entrepreneurial activity.

MOMENT OF CONCLUSION OF THE AGREEMENT

4.1. The text of this Agreement constitutes a public offer pursuant to Article 633 of the Civil Code of Ukraine.

4.2. An Agreement concluded through acceptance of this offer is an adhesion agreement, to which the Buyer accedes without any exceptions or reservations.

4.3. Placement of an Order by the Buyer constitutes unconditional acceptance of the terms of this Agreement.

GOODS AND PURCHASE PROCEDURE

5.1. The Seller ensures individual tailoring of each item of Goods presented on the website. Custom-made Goods are produced within 24 days. Product images may slightly differ from the actual appearance due to display settings. Descriptions and characteristics may contain typographical errors and are not exhaustive.

5.2. Within 48 hours after placing an Order, Customer Support contacts the Buyer to clarify order details, cost, and estimated delivery date.

5.3. If the Seller is unable to contact the Buyer within 30 business days, the Order is canceled.

5.4. The Buyer may place a Custom Order based on individual measurements.

5.6. A Custom Order may not be canceled later than two (2) days after confirmation of all terms by Customer Support.

5.7. An order for standard-size Goods may be converted into a Custom Order only if the Buyer confirms a sizing error.

5.8. In case of cancellation of a prepaid Order, refunds are made using the original payment method.

PRICE AND PAYMENT PROCEDURE

6.1. Prices on the website may be changed unilaterally by the Seller. Prices of already placed Orders remain unchanged.

6.2. The Order price consists of the total cost of Goods plus delivery costs.

6.3. Payment may be made via the LiqPay payment system.

6.4. An Order is considered paid upon receipt of funds to the Seller’s bank account.

6.5. Secure card payments are processed via SSL-encrypted payment gateways. The Seller does not store card details.

DELIVERY

7.1. International delivery costs are not included in the Goods price and are paid by the Buyer.

7.2. The Seller may determine countries where delivery is available and may cover import duties in individual cases.

7.3. In case of refusal to receive an international Order, all related expenses are borne by the Buyer.

7.4. Delivery within Ukraine is carried out via Nova Poshta.

7.5. Risk of accidental loss or damage passes to the Buyer upon receipt of the Order.

RETURNS AND REFUNDS

8.1. The Buyer may return Goods within 14 calendar days in accordance with the Law of Ukraine “On Consumer Protection.”

8.2. Goods of proper quality may be returned provided their original condition is preserved.

8.3. Custom-made Goods are not subject to return or exchange.

8.4. Defective Goods may be repaired or replaced by the Seller.

8.5. Refunds are issued using the original payment method.

CONFIDENTIALITY

9.1. By providing personal data, the Buyer consents to their processing for order fulfillment and marketing purposes.

9.2. The Seller may send informational and promotional messages with the Buyer’s consent.

9.3. Cookies and IP addresses are used for website functionality and analytics.

LIABILITY OF THE PARTIES

10.1. The Parties are liable for non-performance in accordance with Ukrainian law.

10.2. The Seller is not responsible for improper use of Goods by the Buyer.

FINAL PROVISIONS

11.1. Ukrainian law governs this Agreement.

11.2. Disputes are resolved through negotiations or in court.

11.3. Force majeure releases the Parties from liability.

11.4. Invalidity of any provision does not affect the validity of the remaining provisions.
